This is a case where we acted for mother and son who were both injured in the same car accident.
Our clients first contacted us only a couple of days before the three year limitation period for issue court proceedings. Immediate action was therefore taken to issue court proceedings on the same day to avoid the claims becoming statute barred from being pursued.
The son had been driving the car and his mother was his passenger. Due to stationary traffic ahead, the son had to perform an emergency stop. The vehicle behind failed to stop and collided with the vehicle our clients were in. The Defendant driver alleged fault against the son, accusing him of stopping too suddenly and not allowing the driver behind enough time to stop safely behind him. This was disputed by both of our clients and eventually the allegation of negligence against the son was dropped.
The son sustained injuries to his back. Those injuries coupled with his pre-existing disabilities hindered his work capabilities. The mother also sustained whiplash injuries that prevented her from enjoying her previous activities and necessitated her relying on family members to care for her.
We not only negotiated a settlement of both claims but helped the Mother to address her ongoing physical and emotional difficulties.
