Hospital Worker Bicep Injury Caused by Unsafe Manual Handling

Harris Fowler successfully represented a hospital worker who sustained a ruptured bicep while carrying out manual handling duties as part of his employment.

The claimant was required to lift a heavy carpet-cleaning machine into the back of a work van without appropriate equipment or assistance. The strain of lifting the machine resulted in a serious bicep injury, impacting his ability to work and carry out everyday activities.

The claim proceeded to Trial, where the Court accepted that the employer had failed to provide a safe system of work. It was determined that a portable ramp should have been supplied, allowing the machine to be wheeled into the vehicle rather than manually lifted.

Compensation was successfully secured to reflect the pain, suffering and impact the injury had on the claimant’s life and employment.

Over time, the claimant developed contact dermatitis, causing discomfort, skin irritation and ongoing symptoms that affected both his work and daily life.

Harris Fowler acted on behalf of a group of visitors who became seriously unwell after contracting cryptosporidium following a visit to a petting farm.

The claim involved 10 adults and 9 children who developed symptoms after interacting with animals on the farm. Investigations revealed that animals on the premises were infected with cryptosporidium and that the farm operators were aware of the outbreak.

Despite this knowledge, the farm continued to allow members of the public to attend and interact with the animals, exposing visitors to a significant risk of infection.

It was successfully proven that the farm had failed to take appropriate action to protect visitors. Compensation was secured for all affected claimants in recognition of the illness, distress and disruption caused by the outbreak.

Harris Fowler successfully represented a holidaymaker who sustained a significant foot injury while using a swimming pool during a holiday in Turkey.

The claimant suffered a deep laceration to his foot after coming into contact with a protruding bolt located on the floor of the swimming pool. Investigations established that the bolt was missing its protective cap and posed a clear safety hazard.

Evidence showed that the swimming pool had not been properly inspected on the morning of the accident, allowing the defect to remain undetected.

It was successfully proven that inadequate inspection and maintenance procedures had contributed to the accident. Compensation was secured to reflect the injury, recovery period and disruption caused to the claimant’s holiday.

Cruise Ship Swimming Pool Slip Injury Claim

Harris Fowler successfully represented a traveller who sustained a serious leg injury while on board a cruise ship.

The claimant slipped while exiting a swimming pool and suffered a fractured tibia, requiring extensive treatment and recovery. Investigations revealed that cruise ship staff had failed to put in place slip-resistant matting around the pool area on the day of the accident.

It was successfully demonstrated that appropriate safety measures should have been implemented to reduce the risk of slipping in the wet environment surrounding the pool.

As well as securing compensation for the injuries sustained, Harris Fowler also recovered the cost of the claimant’s holiday, recognising the significant impact the accident had on his trip and overall experience.

Shoulder Injury Caused by Repetitive Metalworking Tasks

Harris Fowler successfully represented a metal worker who developed shoulder impingement as a result of repetitive workplace activities.

The claimant spent long periods sanding vehicle components as part of his role, undertaking the same repetitive movements throughout the working day. Despite experiencing increasing shoulder pain and repeatedly raising concerns with his employer, no action was taken to reduce his exposure to the task.

The claim proceeded to Trial, where the Court accepted that the work was repetitive in nature and that the employer should have implemented a system of task rotation to reduce the risk of injury. The Court also accepted that the claimant’s complaints had been ignored.

Compensation was awarded to reflect the pain, suffering and ongoing impact of the injury on the claimant’s working and personal life.
