Understanding the Whiplash Reform

In recent years, the law surrounding whiplash claims has undergone significant reform. At Harris Fowler Solicitors, we are committed to keeping our clients informed about changes that could impact their personal injury claims.

One of the most significant reforms is the Whiplash Reform Programme, which aims to reduce fraudulent claims, simplify the claims process, and ultimately lower insurance premiums.

Here, we explain what the whiplash reform is, who it affects, and how it could impact your personal injury claim.

What is the Whiplash Reform?

The Whiplash Reform is a set of legal changes introduced by the UK government to tackle what they saw as the rising costs of whiplash claims, particularly those following low-impact road traffic accidents. The reform introduced a new framework for handling these claims and aimed to address issues such as exaggerated claims and fraudulent injuries.

The reform came into effect on May 31, 2021, and it introduced a number of key changes to the way whiplash claims are handled, including:

New Legal Definition of Whiplash Injuries

The reform introduced a clearer, more consistent definition of a whiplash injury, which includes soft tissue injuries to the neck, back, and shoulders that occur in a road traffic accident. This new definition makes it easier for insurers and claimants to understand what qualifies as a whiplash injury.

The Whiplash Injury Claims Portal

A new online claims portal was created to simplify the process of making a claim for whiplash injuries. This portal is designed for low-value claims (up to £5,000) and aims to reduce administrative costs and streamline the claims process. Claimants can submit their claim directly through the portal, allowing for faster decisions.

Fixed Compensation Structure

Prior to the reform, the amount of compensation awarded for whiplash injuries could vary depending on the severity of the injury and the impact on the claimant’s life. Under the new rules, compensation is now capped and follows a fixed tariff based on the duration of the injury.

For example, the length of time a person experiences pain and discomfort will determine how much compensation they receive, with a maximum amount of compensation for injuries lasting up to two years.

The cap ranges from £240 for injuries lasting between 0 and 3 months to a maximum of £4,215 for injuries lasting up to two years.

The Removal of “Cash for Crash” Claims

The reform also aims to curb the phenomenon of “cash for crash” schemes, where fraudsters deliberately stage accidents or make exaggerated claims for minor injuries. By limiting compensation to a fixed amount and introducing stricter guidelines, the reform aims to reduce fraudulent claims.

No More Legal Fees for Low-Value Claims

One of the most significant changes is the restriction of legal fees for low-value whiplash claims (claims valued at £5,000 or less). Claimants no longer automatically have the right to recover legal costs if their claim is processed through the new claims portal.

This means that, in many cases, claimants will need to represent themselves or use no-win-no-fee services. While this makes the process easier for some, it also means that the legal assistance available for claimants with low-value claims may be more limited.

Who is Affected by the Whiplash Reform?

The Whiplash Reform primarily affects people who are involved in road traffic accidents and suffer soft tissue injuries such as whiplash. However, it is important to note that not all personal injury claims are subject to these reforms.

      Key groups affected include:

      • Claimants with Low-Value Claims: If you have a whiplash injury from a road traffic accident and your claim is valued at £5,000 or less, your case will likely fall under the new regime. This means you will have to submit your claim through the new online portal.
      • Claimants with Injuries Lasting Less Than Two Years: The fixed compensation tariffs only apply to claims involving injuries that last for up to two years. Injuries lasting longer than two years may still be subject to traditional methods of compensation determination.
      • Claimants Representing Themselves: The reform makes it more difficult for claimants to recover legal fees for low-value claims. This may encourage some individuals to pursue their claims without legal assistance, although Harris Fowler Solicitors can still assist with a no-win-no-fee agreement.

How the Whiplash Reform Affects Your Claim

If you’re considering making a whiplash claim, it’s important to understand how these reforms may impact your case. Here’s what you can expect:

      1. Simplified Process for Low-Value Claims
The introduction of the new online claims portal makes it easier for claimants with low-value claims (under £5,000) to submit their case. However, for claimants who are unfamiliar with the legal process, the lack of legal representation may make the process more difficult.
      2. Fixed Compensation Tariffs
Compensation for whiplash injuries is now based on a fixed tariff that is determined by the severity of your injury and the duration of your pain. While this brings clarity to compensation amounts, it may not always reflect the true impact of your injury. If you have other factors—such as psychological distress or financial losses—these will need to be considered separately.
      3. No More Legal Fees for Low-Value Claims
For low-value claims, you may not be able to recover legal fees if you choose to pursue your case through the new portal. However, if you use a solicitor like Harris Fowler Solicitors, we can offer no-win-no-fee arrangements to ensure you have professional legal support without upfront costs.
      4. Increased Difficulty in Proving Your Injury
While the reform aims to tackle fraud, this has also made it harder for some genuine claimants to prove their injuries. The new system relies heavily on medical assessments and evidence, meaning the burden of proof is on you to demonstrate the extent of your injuries.
