As you may have been involved in an accident that has resulted in a Head or Brain injury, you could be entitled to claim compensation.  At Harris Fowler we know how life changing such injuries can be to you and your family and we specialise in getting you the help and compensation you deserve. This page will set out how we may be able to help you not only get the compensation you deserve but to help rebuild your life.

Immediate Problems

Head and Brain Injuries can be life changing events. Unlike other injuries, however, it is often not clear what the long term effects of such injuries will be.  They are mentioned together as quite often significant head injuries (i.e. damage to the skull and face) will result in brain injury as well; however it does not necessarily follow that a brain injury will only be caused by an impact to the head. The cause of brain injuries can vary greatly and their long term effects will also vary dramatically depending on the area and extent of injury and your body’s ability to repair or work around the damage.  Symptoms can include but are not limited to:

  • Behavioural changes
  • Changes resulting from Hormonal Imbalances
  • Cognitive problems
  • Reduced awareness
  • Problems with communication
  • Emotional changes
  • Problems with decision making
  • Memory problems
  • Physical co-ordination

If you have suffered a head or brain injury as a result of an accident which was not your fault it is important you or a member of your family contact us as soon as possible to discuss your case.

Our specialist Brain Injury lawyers will help you obtain the treatment you need to get you back on the road to recovery. Whilst we may not be able to guarantee the outcome of your treatment we can ensure you receive the best treatment giving you the best possible chance of recovery.

Effects on Relationships

At Harris Fowler we understand the importance of family and relationships. Unfortunately a brain injury can result in changes to pressures on existing relationships. For instance, your increased needs due to ongoing physical co-ordination problems or problems with communication may result in a spousal partner or family member now taking on a care giver role; and inability to make decisions or the extent of cognitive problems may lead to a change in the dynamic of your relationships. In some circumstances relationships may even breakdown entirely.

At Harris Fowler we can either advise you on bringing a claim for the cost of care that is being provided either privately or by a family member; and if the worst does happen and an existing relationship does breakdown we can advise you as to how this will impact your claim for compensation.

Effect on Communication

We understand that communication difficulties caused by a brain injury can be substantial, isolating and frustrating. Where possible, we will work to help restore your ability to communicate by liaising with speech therapists and neuro-linguistic experts concerning treatment and the provision of any technological solution that may aid you.

Effect on Cognitive ability

A brain injury can also have a significant impact on your ability to perceive the world and make decisions. These symptoms may be relatively minor such as decreased levels of concentration or feeling mental fatigue sooner.  In such cases we will do all that we can to assist you in obtaining any recommended treatment or counselling to help you recover.

Unfortunately a brain injury can often result in more significant issues such as problems with executive function or impaired reasoning. These are substantially more problematic for you as they revolve around the brain’s ability to set goals, make plans and then adapt those plans.

The consequence of this is that when your cognitive function is sufficiently impaired you may need assistance in making decisions, managing your finances or even providing instructions to us. If this is the case we can look to appoint a litigation friend or arrange for a professional deputy to be appointed by the Court of Protection. Their role will be to protect and to make decisions about your care and welfare.

Employment

Your brain injury may have a profound impact on your day to day living including your ability to work. We fully appreciate one of the things you will be most concerned about is being able to financially support yourself and provide for your family.

At Harris Fowler we will do all that we can to help you return to work wherever possible by looking at possible adaptations that can be made to allow you to continue with your previous role. In the event that you are not able to continue in your previous role, we will advise you on whether you can claim the cost of retraining to enable you to return to gainful employment when the time is right for you.

Additionally, we will assess whether your injuries will have an impact on your long term career and whether they will affect your ability to earn the same salary now and in the future. We will also consider whether your injuries might result in it being more difficult for you to find other work in the future, we will help you claim compensation for any losses that you have suffered and are likely to suffer in the future.
